Gift Card Terms & Conditions

These Gift Card Terms and Conditions (“Terms and Conditions”) are between you and Split Bread, Inc. (“Split Bread”). By buying, loading or using a Split gift card (a “Gift Card”), you agree to these Terms and Conditions.  These Terms and Conditions apply to all gift card purchases from Split restaurants which are owned and operated by Split Bread, in addition to the Terms of Use, Privacy Policy, and the Terms of Use for Online Ordering.

Gift Cards are not targeted towards, nor intended for use by, anyone under the age of 13. If you are between the ages of 13 and 18, you may only use Gift Cards under the supervision of a parent or legal guardian who agrees to be bound by these Terms and Conditions.

1. Balance

The balance on any Gift Card can be checked at any participating Split restaurant or by calling (415) 296-8009. The balance on any Gift Card is solely the liability of Split Bread. The balance you receive when inquiring over the telephone or online is an estimate only. In most cases, the balance is adjusted 24 hours after you make a purchase, but there may be occasions when the balance adjustment is delayed. The balance on your Gift Card is not insured by the Federal Deposit Insurance Corporation, nor does it earn interest.

2. Redeeming Gift Cards

Gift Cards can be used at any participating Split restaurant or online at www.spliteats.com. Gift Cards cannot be used through any third-party delivery or ordering services, including, but not limited to Caviar, UberEATS, and DoorDash. Gift Cards are not redeemable to purchase another Gift Card or towards previously purchased goods or services.

3. Not Returnable, Not for Resale, or Not for Promotional Use

Gift Cards are non-returnable and not for resale. Gift Cards are not returnable or refundable for cash except in states where and as required by law. Gift Cards may be used as personal or business gifts, but may not be used in connection with any marketing, advertising or other promotional activities. If you are ordering more than $200 in value on one or more cards or for corporate orders, please email feedback@spliteats.com and we would be happy to help you.

4. No Consolidation

Split Bread does not consolidate or combine multiple gift card balances into one gift card.

5. Loading Value on Your Card

You can load value on your Gift Card by visiting any participating Split restaurant. There may be a delay from the time you pay the amount to be loaded onto your Gift Card and those funds being available for use. You may not have more than $200 on any one Gift Card without approval. 6. Compliance with Laws

By purchasing Gift Cards, you certify and represent to Split Bread that you will use the Gift Cards in compliance with the Terms of Use and all applicable laws, rules and regulations, and that the Gift Cards will not be used in any manner that is misleading, deceptive, unfair or otherwise harmful to consumers, Split, Mixt, or Split Bread. In addition, you agree to defend and indemnify Split Bread and its subsidiaries and affiliates from and against any claims, expenses or liabilities made against or incurred by any of them in connection with your use of the Gift Cards or violation of any of these Terms and Conditions.

7. Lost or Stolen Gift Card

You should treat your Gift Card like cash and not disclose your Gift Card information to anyone. If your Gift Card or Gift Card information is lost or stolen, anyone who obtains possession of either may use your Gift Card. You are responsible for all transactions on your Gift Card, including unauthorized transactions. Lost or stolen cards will not be replaced. Split Bread shall have no liability to you for lost or stolen Gift Cards.

8. No Expiration, No Fees

Gift Cards Do Not Expire. Gift Cards never expire. Promotion cards may expire and/or impose fees; please check the specific terms and conditions on the front and back of any such promotion card for details. Split Bread reserves the right to refuse to honor any Gift Card in the event of a disputed credit card charge, bounced check, or other failure of consideration.

9. Changes to these Terms and Conditions

Split Bread may make changes to these Terms and Conditions at any. Posting the terms on this site shall constitute notice and your continued purchase, use, or loading of your Gift Card shall constitute acceptance of any such changes.

10. Assignment

We may assign all or part of these Terms and Conditions without notice to you. We are then released from all liability. You may not assign these Terms and Conditions without our prior written consent and any attempted assignment will be void.

11. Governing Law

When you purchase, receive, or redeem a Gift Card, you agree that the laws of the State of California shall govern these Terms and Conditions, without regard to principles of conflict of laws.
